1. PRICES

Prices are quoted per home per week (not per person). Rates for each rental reflect the maximum occupancy. Reservations are from Saturday to Saturday (unless otherwise agreed). Prices were established according to market conditions. Should these conditions suffer important changes, we reserve the right to modify our prices accordingly before your booking. Once your booking is confirmed the price of your holiday is fully guaranteed and will not be subject to any surcharges. Any alterations to the descriptions, or any extra services required, will only become part of the booking contract if confirmed in writing. Your rental comes with the appliances and amenities as listed on the web page from which you first observed. Please go to that web page to fully familiarize yourself with the items included with the rental of your choice.

 
2. RENTING

The contract of booking is based on the details, descriptions and conditions as set out in the web page for the accommodation concerned, valid on the day of booking for the specified rental period at the prices listed in the price list attached to the descriptions.
The booking reservation must be made on the booking-form. The person asigning the form accepts contractual responsibility for the whole group, in addition to his/her own liability. Through your booking you enter into a rental contract with www.villas-in-tuscany.com. The booking becomes into effect, once the booking confirmation/ invoice has been issued by us and if the deposit issued on the invoice has been settled to our account.
In the event of our insolvency or our bankruptcy, your payments are protected in accordance with legal requirements of the European Community.

 
3. RENUMERATION

On confirmation of the booking by us, a deposit of 50% of the total amount issued in our invoice is due immediately. No extra confirmation of receipt of the deposit is normally given. Balance is due at least 90 days prior to your arrival date. In the case of short term bookings, made less than 90 days prior to the arrival date, payment in full is due immediately. The payment must be done within 5 working days after the booking form. Payment must be done by bank transfer or credit card payment on the web. Each booking is subject to a �20 booking fee . Any incidental charges such as bank transfer fees and credit card commissions will be added to each transaction. Always quote the family name of the tenant and the date of travel with any correspondence or payment. A copy of the wire transfer must be submitted by fax within 5 days of the signing of the booking form.
In case of your default of payment, either deposit or full payment for short term bookings, within the terms of the above-mentioned deadlines, we consider the contract null and void automatically within 5 days. In this case, we are released from any of our obligations. The reservation made for you will be eliminated.

 
4. CHANGE OF LETTING PERIOD

If the accommodation, resort or date of booking is changed after booking confirmation, this will be considered as a cancellation followed by a new booking.

 
5. NUMBER OF PERSONS

The total number of persons need not exceed the authorized number as stated in the web page description. Should the owner, his represenative or the keyholder find more persons than stated, it is up to his or our discretion to ask the clients to vacate the house. Pets are not permitted unless explicitly agreed to in writing. Should the key holder find any violations to this clause, it is totally up to her/his discretion to ask the client to vacate the house without compensation.

 
6. ARRIVAL AND DEPARTURE TIMES

You must arrive between 4pm and 7pm and leave before 10am on the day of departure unless alternative arrangements have been made in advance. You must telephone the keyholder if you are delayed. We cannot guarantee that keys may be collected outside of these times.
If you are unable to take occupation on the day and time reserved due to delays, illness, personal reasons etc. no refund can be made. Similarly if you have to cut short your holiday no refund can be made for the days unused.
If you would like to extend your stay please contact villas-in-tuscany.com and we will inform you immediately whether this is possible.

 
7. UTILITIES AND OTHER EXTRAS

All extras are specified on the property listing and are due in the local currency (Euro) directly to the owner/keyholder upon arrival. Guests have to add these amounts to the refundable security deposit. Only those costs which are calculated according to consumption are to be paid before departure. Rates do not include long distance or local calls where a telephone is provided, these are metered and payable to the owner separately from all other costs. Heating if necessary in the cold month, gas consumption are additional charges unless otherwise noted. Meters will be read upon arrival and departure and the exact charges for these consumptions will be due in cash on departure. Guests riquiring extra maid service or cook service have to pay this service directly at the end of each working day.
Most of our villas can provide one baby cot and/or one extra bed. Please check with us should this be required. It should be noted that the extra bed would be of the folding 'camp bed' style and therefore may only be suitable for a child. Baby cots are usually of the portable 'travel cot' style.

 
8. CLEANING

The property must be left clean throughout by you at the end of the rental period. You must wash and put away all kitchen utensils before your departure. Excessive cleaning upon departure (including but not limited to cleaning of upholstery, shampooing of the rugs, breakage, soiling or damage to the interior or exterior caused strictly by applicant) may be subject to further charges than what is expressed on the page.

 
9. BEHAVIOUR

It is your responsibility to ensure that you and the members of your party do not behave in a way which causes offence or danger to others or which risks damage to property belonging to others. In such circumstances the villa owner/s and the Company have the right to terminate arrangements made on your behalf, in which case the Company's responsibility to you ceases immediately and there can be no refunds, no payment of compensation and no reimbursement of any cost or expenses you may incur as a result. Further, you will be liable to reimburse the Company for any expenses whatsoever it incurs as a result of your behaviour.
Breakages & Cleanliness:
Our accommodation is made available for letting on the understanding that the property will be left clean and tidy at the time of checkout and all personal waste must be removed from the property. It is not our policy to take any security deposit however the customer will be held responsible for any damage or breakages to the property, caused by the customer and in the event of such occurrence, the incident must be reported to the villa owner or their representative immediately and appropriate compensation made. Customers are not permitted to move any furniture or equipment without prior written consent from ourselves or the villa owner. In the event of such permission being granted, it is the customers responsibility to return the same to its original position before checkout. Under no circumstances must any property for use inside the property, be moved outside.

 
10. SECURITY DEPOSIT

Security deposits are due on every property. On arrival the tenant must pay the cautionary deposit as set forth in the online agreement and repeated in the arrival voucher. The required deposit must be paid in cash; cheques will not be accepted. Failure to pay the deposit will result in the keyholder refusing entrance to the house; keys will not be handed over until the deposit has been paid. Please be sure to provide the deposit.
The deposit will be returned in full to the client at the end of the letting period less any deductions made by the owner, his representative or the key holder for damages caused to the house, its garden area, the internal or external furniture, heating costs if metered and any extra expenses incurred during the letting period and still outstanding at the date of departure. Should the damages exceed the security deposit amount, the tenant agrees to pay the additional charges on demand. If you leave without being checked out as arranged your entire security and/or utility deposit will be held. This amount, less any applicable claims and/or unpaid utilities will be returned to you after your departure and after a control of the house by the owner. Judgment as to the condition of the property and the cost of any unpaid utilities is left to the sole discretion of the owner.
Security deposits are made payable directly to the owner or guardian of the rental and collection is made through the same. We can not be held liable for the loss of a security deposit for any reason whatsoever, nor can we be held liable in anyway due to a dispute arising from a security deposit.

 
11. CANCELLATION

If the tenant cancels the rental before travelling, a written declaration must be submitted. Cancellation becomes effective at the day, when your declaration of cancellation is received by www.villas-in-tuscany.com. The compensation claim will be estimated as a fixed amount, at a percentage rate of the rental price according to the cancellation date as per following scale:

10% handling fee
20% if cancellation happens 28 weeks before the beginning of your stay
50% if cancellation happens 20 weeks before the beginning of your stay
100% if cancellation happens 12 weeks before the beginning of your stay

 
12. RESPONSABILITIES OF THE OCCUPANTS

The holiday home must be treated with care and respect. On departure, the accommodation must be left clean. The tenant is obliged to avoid or minimize any possible disruptance to services arising during his stay within the bounds of legal requirements.

 
13. LIABILITY FOR AMENITIES AND NON ESSENTIAL ITEMS

Where pools are provided, the general season for pools to be opened begins June 1 and ends September 30. Generally, neither fans or air conditioning are provided in any of our villas or apartments.
Please note: In Italy the period during which heating can be used depends on local laws and may vary from region to region. In the houses published in this web pages, heating is usually allowed from November 1 until April 30. Some owners have a way around this through independant heat, but this is not guaranteed in any case.

 
14. LIABILITY

www.villas-in-tuscany.com acts as the booking agent between the tenant and the owner of the property and can not be held responible for the actions of either party or consequences therefrom.
We guarantee and vouch for:
- correctness of rental agreement
- control and careful choice of accommodation
- correctness of description of the accommodation
Under no circumstance shall www.villas-in-tuscany.com be responsible for any personal loss by individuals renting the accommodations represented by us, expenses, claims, or injury, direct or indirect, caused or incurred before, during or after the party's stay in the accommodations represented by us including attorney's fees. www.villas-in-tuscany.com will not be held liable and will be otherwise rendered harmless for any events arising in law as a result of any delay(s), substitution(s), rescheduling(s) or change(s) in the provision of accommodations or services provided by us for reasons of military action, revolutions, terrorism and natural disasters. You agree to idemnify and hold www.villas-in-tuscany.com harmless for any claims arising from a violation of the booking conditions of this agreement or of any third party claims. We solely have the full discretion to refuse or discontinue service to any person, and/or rescind any contract for accommodations of guest services. We will not be held liable under any circumstances, including substitutions, to refund any unused portion of booked accommodations or services as described in these booking conditions. These booking conditions are the conditions by which will govern the reservations of all accommodations where we act as the representative and agent, unless otherwise provided. www.villas-in-tuscany.com will have sole discretion to determine choice of forum and law provisions.

 
15. ALTERATIONS AND CANCELLATIONS BY US

Though it is unlikely we will have to make any changes to confirmed arrangements, it does occasionally happen and we will advise you at the earliest possible date. If for some unforseen reason a confirmed accommodation can not be provided because it is either destroyed, uninhabitable due to structural damage or essential equipment and fixtures such as heating, electrical systems, plumbing, hot water being out of operation, or rented to another party by error, or is unihabitable because it is not in working order per these booking conditions, www.villas-in-tuscany.com will immediately attempt to find another accomodation of similar qualities, cost and size. The price difference, if greater, must be paid by you, and, if smaller, will be reimbursed by us. If it is not possible to offer an equivalent or the client refusing to rent the alternative accommodation, either side may terminate the booking contract. In this case the liability of www.villas-in-tuscany.com is limited to the reimbursement of payments made by the client.

 
16. COMPLAINTS

Any complaints concerning the accommodation must be reported to the house owner or his representative or to us and in writing to us within 48 hours of the complaint or dissatisfaction arising (Fax: +39-0571-409148). We will, through our local agents, use our best efforts to arrange for these problems to be solved. Clients leaving the accommodation prematurely without expressive consent of www.villas-in-tuscany.com loose all right to claim possible reimbursement. Complaints lodged at the end of the rental period will not be taken into consideration. Likewise, complaints made after departure from the accommodation cannot be verified and, therefore, cannot be considered for any possible reimbursement. Please note: Houses in Italy are alotted a limited amount of electricity (3 - 6 kilowatts). Although it happens very seldom, using too many appliances at the same time will shut off the house breaker. This does not mean that there has been a power failure, only that a breaker in the house has been triggered. It needs to be switched back on. Similar to the U.S. and other European countries, the panel is inside the house. Please be careful to limited the simultaneous use of electrical appliances. www.villas-in-tuscany.com will not provide a refund if electricity is lost temporarily due to a breaker being triggered.

 
17. DISPUTE

British legislation applies for the contractal relationship. Legal proceecings, arising out of, or in connection with this contract, which cannot be amicably settled, will be governed in all respects by the law of the United Kingdom and all parties submit to the jurisdiction of London courts at all times. You acknowledge that you have received, understand and agreed to these booking conditions. On sending the booking form the client and his/her party totally and unconditionally accepts these booking conditions, for proof a rental agreement will be signed by both parties.

 
18. GENERAL

Ineffectiveness of single clauses of these conditions do not automatically nullify the conditions in total.
